Human Resources - Employee Relations Specialist – North Asia Lead – Vice President

Your key responsibilities:

This is a stand-alone senior ER role for North Asia, which requires leading and managing all ER matters including regulatory / market misconduct, sexual harassment, complaints, grievances, whistleblowing cases and sometimes support legal in significant, high profile litigation cases. The Bank requires a senior ER specialist with strong stakeholder management skills at all levels of the organisation and deep ER subject matter expertise to provide crisis-response capability and ER advisory support to country management and HR across North Asia.

  • Conduct internal investigations of potential HR policy violations, including allegations of harassment, discrimination, and retaliation
  • Participate in working groups to review findings and recommend disciplinary action in cases investigated by other functions such as AFCI and GAI
  • Provide guidance to HR Business Advisors regarding complaints and disciplinary matters including investigations led by HR Business Advisors
  • Conduct calibration of prior cases to determine recommendations regarding any disciplinary outcomes and maintain global consistency and calibration
  • Manage disciplinary, performance improvement and grievance management procedures appropriately
  • Analyze case outcomes to identify trends and collaborate with HR Business Advisors to recommend proactive measures to remediate identified issues
  • Provide guidance to HR Business Advisors and managers regarding Temporary Paid Leave and Variable/Deferred compensation Suspension Process for individuals who are the subject of investigations, including active communication with custodians and others
  • Conduct annual review of HR policies to reflect changes in employment law and ensure consistency with best practice
  • Provide HR policy guidance to managers, employees, and HR Business Advisors
  • Educate HR staff on changes to DB Consequence Management policies, processes, employment law, and ER/Consequence Management best practices regarding Internal Investigations, disciplinaries and grievances
  • Present training/briefing sessions to HR colleagues & deliver ER training for business managers to develop line management expertise and capability from an ER perspective
  • Prepare Management Information to facilitate trend analysis and reporting
  • Develop and facilitate professional conduct training for summer intern population, new hires and other stakeholders as required
  • Participate in special projects on a regional and global basis
  • Oversee the co-ordination and governance of investigations within Consequence Management in North Asia to ensure a consistent approach across the region to meet global standards, while taking into account local legal considerations
  • Partner closely with control function heads as well as supporting both the APAC CEO / Member of the Management Board and the Regional Head of HR, APAC

Your skills and experience:

  • Previous experience working in Employee Relations, particularly in relation to managing high profile, complex employee misconduct cases or complex investigations
  • Strong knowledge of employment law relevant to the North Asia region, or APAC more broadly
  • Effective stakeholder management
  • Experience of influencing all levels of the organisation including senior HR management, senior Control functions and senior business and infrastructure heads
  • Critical analysis and ability to distil issues from complex investigative reports; sound judgement skills
  • Experience of regulatory and regulatory reporting environment
  • Ability to handle highly confidential and sensitive information and maintain discretion as required
  • Ability to exercise independent judgment, maintain a conflict free environment and make effective decisions in a timely mannerIssue recognition, investigative, analytical, mediation and sound judgement skills
  • Ability to work in pressurised time periods and in a virtual work environment
  • A high level of proficiency in reading, speaking and fluent conversation in English as a business language is a must
  • Specialist in employment law
  • Ability to present and deliver training effectively and commercially in an interactive setting
  • Strong oral and written communication and listening skills
  • Outside the box thinker - agile and flexible with an ability to adapt style and plans according to the situation, stakeholder dynamics and multiple competing deadlines
  • Confident self-starter, execution focused and experience working in a matrix environment with minimal handholding and a remote team environment
  • Collaborative, ability to build productive partnerships, internally within the team and with both the business and different areas in HR to drive execution and operational excellence
  • Acute attention to detail in all aspects – advisory ability, applicable legal and regulatory knowledge, written and communication skills.
  • Advance level of business acumen within banking and financial services and deep commercial orientation. Prior experience working within investment banking, retail banking, asset/wealth management
  • Good demonstrable management skills
  • Ability to coordinate and ensure a consistent approach across a disparate area
  • Strong academic track record. Bachelor, masters or an equivalent degree level education in Business, Law and Regulation is a strong preference.
