Global Legal plays an important role in protecting the Group’s reputation by helping to future-proof the organisation through robust legal risk and issue advisory. Responsible for providing comprehensive legal advice to senior management and all global businesses and functions, the team offers a diverse range of legal skills, jurisdictional experience and practice specialisms across all countries and territories in which our businesses operate.


We are currently seeking a high calibre professional to join our team as a Senior Legal Counsel.


Principal Responsibilities


  • As part of the Markets & Securities Services (MSS) Legal team of the HSBC Global Banking and Markets (GBM) division, the job holder’s primary function is to act as senior advisor to the Securities Services (SSv) business within MSS in the Asia-Pacific Region

  • Provide expert and professional legal advice, guidance and support to ensure that the legal and reputational risks in SSv business lines are identified, reported and mitigated

  • Provide advice and assistance with respect to global custody, local custody, fund administration and transfer agency and trustee services on legal developments and regulatory change

  • Work closely with global advisory and client documentation lawyers supporting MSS and the wider GBM businesses

  • Contribute to applicable SSv business management and governance meetings; provide advice and support to senior management and business colleagues across product lines at both regional and global levels in identifying, formulating, coordinating and communicating policies, procedures and controls to ensure that HSBC Group’s exposure to legal risks is effectively managed

  • Provide legal advisory support on a variety of legal matters, or in a specialist area, including matters that may be complex or may have some impact on the MSS business

  • Be a trusted advisor to the business by ensuring that commercially sensitive, pragmatic and practical legal support and advice is provided in a cost-effective manner

  • Provide support and guidance to MSS business and stakeholders with regard to legal risks arising in Securities Services

Requirements


  • 5 years or more PQE lawyer with private practice and/or relevant post qualification experience with an international bank in a security services, trustee services, investor services business and/or asset management business

  • Up to date knowledge and experience of developments in relation to securities services and/or asset management, including agency securities lending, custody, clearing, depositary, credit/lending, foreign exchange, trustee services and ancillary products

  • The job holder assists GBM senior management to manage legal risk across the GBM business in accordance with established policies and procedures.The diversity of HSBC’s business, its geographic spread and the constant changes internally and externally means the diversity of matters which the job holder is required to manage and advise on is very wide

  • The role requires an understanding of the structure of the HSBC Group and its culture and the ability to handle increasingly complex legal issues

  • The job holder must also establish close mutually supportive working relationships with other members of the GBM Legal team and the Global Legal Function

  • Works largely autonomously, but seeks management input on unusual situations, highly complex issues, and matters that may pose significant legal, financial and / or reputational risk to the company

  • Knowledge and experience of banking, corporate and securities law concepts and a working knowledge of the laws in the major jurisdictions in which HSBC operates

  • Able to handle a diverse range of legal and regulatory issues, e.g. general banking, custody, regulatory developments etc

  • Corporate and/or Compliance experience in international bank(s) an advantage, but not essential

  • Self-starter, independent with good organisational skills and the ability to prioritise effectively

  • Excellent communication, negotiation and interpersonal skills and a team player

  • Lateral thinking/problem solving
